General Terms and Conditions
of the online offer of Toms Korallen

1. General information

   All services provided by the online store for the customer are provided exclusively on the basis of the following General Terms and Conditions. Deviating provisions shall only apply if they have been individually agreed between the online store and the customer.

   2. conclusion of contract

   2.1 The offers of the online store on the Internet represent a non-binding invitation to the customer to order goods in the online store.

   2.2 By ordering the desired goods on the Internet, the customer submits a binding offer to conclude a purchase contract.

   2.3 The online store confirms receipt of the order immediately after receipt of the order. The order confirmation as well as the receipt of a telephone order do not constitute a legal acceptance on our part. We only accept the offer when we dispatch the goods to you. You will receive a written shipping confirmation by e-mail.

   2.4 The subject matter of the contract is the goods ordered by the customer. With regard to the quality, the description of the offer shall apply, otherwise § 434 para. 1 sentence 3 BGB shall apply.

   4th delivery

   4.1 All items are delivered immediately, provided they are available from stock.
   Delivery takes place both within Germany and to EU countries.

   4.2 Unless otherwise stated in the offer, the delivery time within Germany is a maximum of 5 working days. Delivery will therefore be made within 2 working days (Monday to Friday, excluding public holidays) at the latest after the payment order has been issued to the remitting bank (in the case of advance payment) or after conclusion of the contract (in the case of cash on delivery or purchase on account). Designated products are shipped directly by the manufacturer. There may be delays due to production. 

   For deliveries abroad, the delivery time is a maximum of 14 working days, unless otherwise stated in the offer. Delivery will therefore be made within 2 working days (Monday to Friday, excluding public holidays) at the latest after the payment order has been issued to the remitting bank (in the case of advance payment) or after conclusion of the contract (in the case of cash on delivery or purchase on account).

   4.3 If an item is not available at short notice, we will inform you by e-mail about the expected delivery time, provided we have an address from you.

   4.4 We hereby expressly exclude neighborhood parcel acceptance, parcel redirection and garage contracts with the delivery service from our shipping conditions. Should this nevertheless be used by the customer, this is beyond all our possibilities of a delivery guarantee.

   4.5 Customers from Switzerland and all other countries outside the European Union should note that country-specific customs duties may still be levied on orders. Please contact your local main customs office for information on the customs duties to be expected.

   Your statutory claims remain unaffected.

   5. packaging and shipping costs

   5.1 We offer the following shipping methods: Live animal shipping with GO!, UPS and other products via DHL.
   5.2 For delivery within Germany and packaging costs, we charge the shipping price specified in the offer. The shipping costs are shown and communicated separately for each order.

   5.3 Unforeseen obstacles to delivery entitle us to withdraw from the delivery obligation in whole or in part. Liability for damages due to delivery delays is excluded. Deliveries abroad are only made against prepayment or Paypal. In countries of the EC, the VAT valid in Germany is included if we do not have a VAT ID number. In all other countries we deliver without VAT.

   There are no free shipping arrangements for deliveries abroad.

   6 Payment, retention of title

   6.1 All prices quoted are gross prices in euros, which include the statutory VAT of currently 19 % or 7 %. The prices valid on the order date shall apply.

   6.2 The following payment methods are possible for deliveries within Germany:

   by Paypal (our address for this is: info@toms-korallen.de) please also state the order number and your name as the reason for payment.

   by prepayment,
   (The customer is obliged to pay the purchase price by bank transfer to our account after conclusion of the contract).

   6.3 The delivered goods shall remain our property until full payment has been made (retention of title in accordance with §§158, 449 BGB). The customer must inform us immediately of any enforcement measures by third parties against the goods subject to retention of title, handing over the documents necessary for an intervention; this also applies to impairments of any other kind. Irrespective of this, the customer must inform the third parties in advance of the existing rights to the goods.

   7. warranty

   If the supplementary performance has taken the form of a replacement delivery, the customer shall be obliged to return the goods first delivered to us at our expense within 30 days. The defective goods must be returned in accordance with the statutory provisions. We reserve the right to claim damages under the statutory conditions.

   9. data protection

   Our privacy policy is available under data protection.

   10. copyright

   The content and works created by the site operators on these pages are subject to German copyright law. Duplication, processing, distribution and any form of commercialization of such material beyond the scope of the copyright law shall require the prior written consent of its respective author or creator. Downloads and copies of this site are only permitted for private, non-commercial use. Insofar as the content on this site was not created by the operator, the copyrights of third parties are respected. In particular, third-party content is identified as such. Should you nevertheless become aware of a copyright infringement, please inform us accordingly. If we become aware of any infringements, we will remove such content immediately.

   The contents of our pages have been created with the greatest care. However, we cannot assume any liability for the accuracy, completeness and topicality of the content. As a service provider, we are responsible for our own content on these pages in accordance with § 7 (1) TMG (German Telemedia Act) and general laws.    The linked pages were checked for possible legal violations at the time of linking. Illegal contents were not recognizable at the time of linking.    12. final provisions

   The application of the UN Convention on Contracts for the International Sale of Goods is excluded; German law shall apply. By placing an order, the General Terms and Conditions of the online store are recognized.

   If the customer does not have a general place of jurisdiction in Germany or in another EU member state, the exclusive place of jurisdiction for all disputes arising from this contract shall be our registered office
